1. Korzystanie z Platformy B2B odbywać może się wyłącznie na zasadach i w zakresie wskazanym w Regulaminie, który określa ogólne warunki, zasady i sposób sprzedaży przez SimpleAV Sp. z o.o. jako Sprzedawcę.
2. Klient oświadcza, że osoby, których dane widnieją w Upoważnieniu, mają stosowne umocowanie do działania w imieniu i na rzecz Klienta.
3. Klient jest uprawniony do korzystania z zasobów Platformy B2B wyłącznie na własny użytek. Nie jest dopuszczalne wykorzystywanie zasobów i funkcji Platformy B2B w celu prowadzenia przez Klienta działalności takiej, która naruszałaby interes Sprzedawcy.
4. Klienci powinni stosować właściwe środki techniczne, które zminimalizują zagrożenia wynikające z korzystania z sieci internetowej, a w szczególności stosować programy antywirusowe i chroniące tożsamość korzystających z sieci Internet. Sprzedawca nigdy nie zwraca się do Klienta z prośbą o udostępnienie mu w jakiejkolwiek formie Hasła.
5. Klient ma obowiązek zapoznać się z treścią Regulaminu, co potwierdza zaznaczając odpowiednie pole na deklaracji przesłanej do Sprzedawcy. Stanowi to oświadczenie Klienta o zapoznaniu się treścią Regulaminu i akceptacji jego postanowień, a także o poinformowaniu o niniejszych warunkach korzystania z Platformy osób wskazanych w Upoważnieniu.
6. Klient zobowiązany jest dołożyć wszelkich starań w celu zachowania poufności i nieudostępniania osobom trzecim Hasła. Klient ponosi pełną odpowiedzialność za działania swoich pracowników oraz innych osób, którym udostępni hasło i login.
7. Klient zobowiązany jest do niezwłocznego informowania Sprzedawcy o zmianie osoby uprawnionej do korzystania z platformy B2B lub o ograniczeniu jego upoważnienia do działania w imieniu i na rzecz Klienta. W braku takiej informacji Klient będzie w pełni odpowiedzialny za działania takiej osoby, której uprawnienie do korzystania z platformy B2B wygasło lub zostało ograniczone.
8. W razie zaistnienia okoliczności wskazujących na podejrzenie, iż Hasło znalazło się w posiadaniu osoby nieuprawnionej, Klient ma obowiązek niezwłocznego zawiadomienia o tym fakcie Sprzedawcę, z wykorzystaniem dostępnych środków łączności. W takiej sytuacji Klient otrzyma od Sprzedawcy nowe hasło.
9. W przypadku udostępnienia loginu i hasła podmiotom nieuprawnionym, bądź niepoinformowania Sprzedawcy o tym, że hasło znalazło się w posiadaniu osoby nieuprawnionej, i wystąpienia z tego powodu po stronie Sprzedawcy szkody, Klient będzie zobowiązany do jej naprawienia w całości.
10. Klient wskazuje w formularzu Zamówienia adres dostawy zamówionych produktów. Sprzedawca nie weryfikuje poprawności wskazanego adresu. Wszelkie koszty i ryzyko związane z podaniem nieprawidłowego adresu dostawy bądź nieodebraniem przesyłki pod wskazanym adresem ponosi wyłącznie Klient.
11. Sprzedawca nie ponosi odpowiedzialności za niewykonanie lub nienależyte wykonywanie usług świadczonych drogą elektroniczną, jeżeli jest to spowodowane przez osoby trzecie (w szczególności operatorów telekomunikacyjnych, dostawców łączy telekomunikacyjnych i energii elektrycznej).
12. Sprzedawca nie ponosi odpowiedzialności za niemożliwość lub utrudnienia w korzystaniu z Platformy B2B, wynikające z przyczyn leżących po stronie Klienta, w szczególności za utratę przez Klienta lub wejście w posiadanie przez osoby trzecie (niezależnie od sposobu) jego Hasła.
13. Sprzedawca nie ponosi odpowiedzialności z tytułu szkód spowodowanych działaniami lub zaniechaniami Klientów, w szczególności za korzystanie przez nich z Platformy B2B w sposób niezgodny z obowiązującymi przepisami prawa lub Regulaminem.
14. Niniejszy Regulamin obowiązuje od dnia opublikowania go na Stronie Platformy B2B i zastępuje poprzednio obowiązujące Regulaminy Platformy B2B w tym udzielone Upoważnienia.
15. Treść niniejszego Regulaminu może zostać utrwalona poprzez wydrukowanie, zapisanie na nośniku lub pobranie w każdej chwili ze Stron Internetowych Platformy B2B.
16. Regulamin może ulec zmianie. O treści zmian Regulaminu każdy Klient zostanie dodatkowo poinformowany przez wypełnienie nowego Upoważnienia niezbędnego do obsługi Platformy B2B.
17. Wszystkie zamówienia przyjęte przez Sprzedawcę do realizacji przed dniem zmiany Regulaminu są realizowane na podstawie Regulaminu, który obowiązywał w dniu składania zamówienia przez Klienta.
18. Jeżeli jakakolwiek część Regulaminu okaże się nieważna lub nieskuteczna w świetle przepisów obowiązującego prawa należy tę część interpretować w taki sposób by była ona zgodna z prawem właściwym i odzwierciedlała najbliżej jak to możliwe intencje danego zapisu. Pozostałe części Regulaminu pozostają w pełnej mocy i są w pełni skuteczne.
19 W przypadku powstania sporu na gruncie zawartej Umowy sprzedaży, Strony będą dążyły do rozwiązania sprawy polubownie. Prawem właściwym dla rozstrzygania wszelkich sporów powstałych na gruncie niniejszego Regulaminu jest prawo polskie, a sądem właściwym będzie właściwy dla siedziby Sprzedawcy.
20. Regulamin wchodzi w życie z dniem 28.05.2018r.

10. Klient wskazuje w formularzu Zamówienia adres dostawy zamówionych produktów. Sprzedawca nie weryfikuje poprawności wskazanego adresu. Wszelkie koszty i ryzyko związane z podaniem nieprawidłowego adresu dostawy bądź nieodebraniem przesyłki pod wskazanym adresem ponosi wyłącznie Klient.
11. Sprzedawca nie ponosi odpowiedzialności za niewykonanie lub nienależyte wykonywanie usług świadczonych drogą elektroniczną, jeżeli jest to spowodowane przez osoby trzecie (w szczególności operatorów telekomunikacyjnych, dostawców łączy telekomunikacyjnych i energii elektrycznej).

3. Based on legally valid requests and within the scope of such a request, the operator may be obligated to provide authorised bodies with information collected by the Service.
Collecting and processing data
The Administrator of any Personal Data collected is
SimpleAV Sp. z o.o., al. Karkonoska 10, 53-015 Wrocław.
Processing of any data will be held only by employees of the Administrator and will not be subjected to automatic decision making, including profiling. The collected data is processed in order to contact the User and is stored for the time necessary to provide a satisfying explanation and answer to the problem or until the moment of the User's request to stop processing their data.
We inform that you have the right to lodge a complaint to the data protection supervisory authority.
We inform that we use the services of other providers for ex. information and communication system support therefore personal data may be transferred outside the EU. In such case we ensure that the transfer will take place in accordance with the conditions established by the European Commission.
We inform that we process your personal data and you have the right to request access to data, rectify data, delete data, restrict data processing, transfer data, not have your data subjected to automatic decision making, including profiling, and have the right to object to the processing of your personal data. In case you want to delete your personal data, write a request to dane@simpleav.pl.
Recruitment.
To join the recruitment process organized by SimpleAV Sp. z o. o., please add the following information to your recruitment application:

If you want your application to be considered in future recruitment processes, please add the following information:

In case you attach your personal image to your application, please add the following information:
„I hereby consent to my personal image being processed by SimpleAV Sp. z o.o. in Wrocław in form of the photograph attached to my application for the purpose of recruitment process for the position of*... and for any future recruitment processes.”

The legal basis of Personal Data Processing:
We process your personal data when we must act at your request before entering into an employment contract (Art. 6 (1) (b) of the GDPR).
Data storage:
We actively process your personal data collected exclusively for the purposes of certain recruitment procedures and only in the course of the recruitment process (max. 3 months). If you agree for the processing of personal data for future recruitment procedures, the data is actively processed for 6 months.
